1. Introduction & Acceptance of Terms
1.1. Welcome
Welcome to our Service. These Terms of Service ("Terms") govern your use of our applications, websites, software, and related services (collectively, the "Service") provided by ("we," "us," or "our"). Our Service offers users the ability to generate creative written content using artificial intelligence ("Stories") and to convert that text into audio using advanced Text-to-Speech ("TTS") technology.
1.2. Binding Agreement
By creating an account, accessing, or using the Service in any manner, you ("you," "your," or "User") acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree to these Terms, you may not access or use the Service. If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.
1.3. Changes to the Terms
The field of artificial intelligence and its governing legal frameworks are subject to rapid and continuous evolution. To ensure our Service remains compliant with applicable laws and adapts to new technologies and ethical standards, we reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes, for example, by sending an email to the address associated with your account or by posting a prominent notice within the Service. All changes are effective immediately when we post them. Your continued use of the Service after such changes become effective constitutes your binding acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.
2. Description of the Service
2.1. Core Functionality
The Service provides tools for generating original written content ("Stories") based on user-provided prompts and parameters, powered by advanced generative artificial intelligence. The Service also includes Text-to-Speech (TTS) functionality, allowing users to convert generated or provided text into spoken audio using a variety of synthetic voices.
2.2. Service Tiers and Subscriptions
We may offer various tiers of service, including free and paid subscription plans ("Free Tier," "Bronze Tier," etc.). Each tier has different features, capabilities, and usage limits. The specific rights granted to you depend on your subscription level. A critical distinction is made between personal, non-commercial use and commercial use, which is typically reserved for paid subscribers.
The distinction between commercial and non-commercial use rights serves as a fundamental component of our service structure and risk management strategy. By limiting free-tier usage to non-commercial purposes, we mitigate our exposure to potential disputes arising from the commercial application of AI-generated content. Paid tiers, which grant explicit commercial rights, are designed for professional and business use cases where a different risk profile is acknowledged and accepted by the User.
2.3. Subscription Terms and Automatic Renewal
For any paid subscription, you agree to pay all applicable fees. If you subscribe to the Service for a specific term (the "Initial Term"), your subscription will be automatically renewed for additional periods of the same duration as the Initial Term at our then-current fee for such services, unless you cancel your subscription through your account settings prior to the end of the current term.
2.4. Credits and Payments
The Service may operate on a credit system (e.g., character credits, generation credits). All payments are processed through our third-party payment processors. You agree to provide current, complete, and accurate purchase and account information. All fees paid are non-refundable, except as expressly stated in any applicable refund policy or as required by law. Any unused credits associated with your account are non-transferable and will be forfeited upon account suspension or termination. We reserve the right to expire unused credits after one year of inactivity on your account.
3. User Accounts & Eligibility
3.1. Age Requirements
If you are under 18 years of age (or the age of legal majority in your jurisdiction), you must have the permission of your parent or legal guardian to use the Service, and your parent or legal guardian must agree to these Terms on your behalf.
3.2. Account Registration
To access most features of the Service, you must register for an account. You agree to provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
3.3. Account Security
You are solely responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. Sharing of individual account credentials is a violation of these Terms. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3.4. Account Suspension and Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms. Specific grounds for termination include engaging in illegal activities, violating our Acceptable Use Policy, or creating a risk or harm to the Service, our users, or the public. We may also terminate or suspend accounts that have been inactive for over a year and are not on a paid subscription plan, after providing advance notice. Upon termination, your right to use the Service will immediately cease, and all unused credits will be forfeited.
4. User Content & Intellectual Property
4.1. Definitions
- "Input": Any data, text, prompts, audio recordings, or other materials you provide, upload, or submit to the Service.
- "Output": The stories, text, audio, and other content generated and returned by the Service based on your Input.
- "Content": Collectively, your Input and your Output.
- "Models": Our proprietary, underlying foundational artificial intelligence models, including large language models (LLMs) and voice synthesis models, which are our exclusive property and are not part of the Output.
4.2. Ownership of Content
- Your Ownership: You retain all pre-existing rights, title, and interest in your Input. Subject to your compliance with these Terms and to the fullest extent permitted by applicable law, you are the owner of the Output you create. This contractual assignment of ownership is a significant aspect of our Service, placing you in control of the content you generate. However, this ownership also confers responsibility. If the Output you generate infringes on a third party's rights, your ownership makes you the primary party responsible for that infringement, and you are obligated to indemnify us as detailed in Section 9.4.
- Our Ownership: We and our licensors exclusively own all rights, title, and interest in and to the Service itself, including all software, websites, and our proprietary Models. These Terms do not grant you any rights to our underlying intellectual property or technology.
4.3. License You Grant to Us
In order to operate, maintain, and improve the Service, you grant us a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and perpetual license to host, store, use, reproduce, modify, adapt, create derivative works of, display, perform, and distribute your Content. This license is granted for the following limited purposes:
- Providing, personalizing, and maintaining the Service for you;
- Improving our Service and training our Models to be more accurate, safe, and useful.
- Developing new technologies, features, and services;
- Preventing fraud, abuse, and security threats, and enforcing our policies; and
- Complying with applicable laws and legal obligations.
4.4. Disclaimer on Output
Due to the probabilistic nature of machine learning, Output generated by the Service may not be unique across users. The Service may generate the same or substantially similar Output for you and for other users who provide similar prompts. You have no right, title, or interest in Output generated for other users. Furthermore, you acknowledge that all Output is generated by an AI system and may contain inaccuracies, errors, or offensive material that does not represent our views. You are solely responsible for evaluating the accuracy, legality, and appropriateness of any Output for your use case, including through human review, before using, relying on, or publishing it.
4.5. User Representations and Warranties
You represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to submit your Input and to generate Output. You further warrant that your Content, and our use of it as permitted by these Terms, will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or any other personal or proprietary rights.
5. Voice Input Feature (Non-Cloning)
This section describes the terms for using our general voice input feature, which allows you to speak your prompts and other inputs instead of typing them. This feature is distinct from the Voice Cloning service described in Section 6.
5.1. Functionality and Consent
By using the voice input feature (e.g., by clicking a microphone icon and speaking), you consent to the temporary recording and processing of your voice for the sole purpose of transcribing your speech into text. This text is then used as your "Input" for the requested action, such as generating a story.
5.2. Limited Use and Data Handling
We want to be explicitly clear: Audio recordings collected through this general voice input feature are treated as ephemeral data. They are used exclusively for the immediate transcription process and are not used to create a User Voice Model, for voice cloning, for user identification, or to train our AI models. The app itself doesn't directly handle the processing and storage of speech data. Instead, it acts as an intermediary, using the platform's native speech recognition capabilities (like those in Android or iOS) to convert speech to text. Therefore, whether or not your voice input is shared with third-party voice recognition systems and potentially stored depends on which underlying speech recognition service the native platform is configured to use and its associated privacy policies.
6. Voice Cloning Services (Optional Feature)
This section governs your use of our optional Voice Cloning feature, which allows you to create a synthetic version of a voice (a "User Voice Model") for use in TTS generation. This feature involves the processing of sensitive data and is subject to strict conditions.
6.1. Explicit, Affirmative Consent
The Voice Cloning feature is strictly opt-in. You will not be able to use this feature unless you first provide your explicit, affirmative consent through a clear and conspicuous interface presented to you before you record or upload any audio files. Use of this feature is entirely optional and is not required to access the core story generation features of the Service.
6.2. Biometric Data Acknowledgment and Consent
You acknowledge and agree that your voice, and the mathematical representations derived from it to create a User Voice Model (a "voiceprint"), may be considered "biometric identifiers" or "biometric information" under various laws, including but not limited to the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), and other similar state, federal, or international regulations like the EU's General Data Protection Regulation (GDPR).
By checking the consent box and proceeding to use the Voice Cloning feature, you are providing your explicit, informed written consent and release for us to collect, capture, store, use, and process your voice and associated biometric data for the purposes, and for the length of time, described in these Terms and our Privacy Policy. This is a critical legal step; without this consent, we cannot provide this feature to you.
6.3. License for Your Voice Data
You grant us a specific, limited license to use the audio recordings you provide ("Voice Input") for the sole and exclusive purposes of:
- Creating, hosting, and maintaining your User Voice Model for your private use within your account; and
- Conducting internal research and development to train, improve, and enhance our voice synthesis technologies and underlying Models. This use is subject to your opt-out rights as described in the Privacy Policy.
Our Commitment to You: We will not use your unique voice or User Voice Model to create voice models for any other user. We will not sell, lease, publicly distribute, or otherwise commercialize your User Voice Model or your voice on a standalone basis without obtaining separate, explicit, and specific consent from you for that purpose.
6.4. Your Rights and Control
You retain full control over your Voice Input and User Voice Model. You may delete your Voice Input and your associated User Voice Model from our systems at any time through your account settings. Upon receiving a deletion request, we will cease all future use and will permanently erase the data from our active systems in accordance with our data retention policies. This action is irreversible.
6.5. Prohibited Voice Submissions
You represent and warrant that you are the individual whose voice is contained in any Voice Input you provide, or that you have obtained a legally binding, verifiable, and written consent from the individual whose voice you are submitting. You are strictly prohibited from recording, uploading, or attempting to create a User Voice Model of any person without their explicit prior consent. This prohibition is absolute for the voices of minors. A violation of this section is a material breach of these Terms, will result in the immediate and permanent termination of your account, forfeiture of all fees paid, and may expose you to civil and criminal liability. We reserve the right to cooperate fully with law enforcement authorities in the investigation of any such violation.
7. Acceptable Use Policy
7.1. Prohibited Conduct
You agree not to use the Service, or permit the Service to be used, for any purpose that is illegal, fraudulent, harmful, or in violation of these Terms. Prohibited activities include, but are not limited to:
- Violating any applicable local, state, national, or international law, regulation, or statute.
- Infringing upon or violating the intellectual property rights (e.g., copyright, trademark), privacy rights, publicity rights, or other proprietary rights of any third party.
- Distributing, transmitting, or uploading any software or other materials that contain viruses, worms, Trojan horses, defects, or other items of a destructive nature.
- Engaging in any activity that interferes with or disrupts the Service, its servers, or networks, including scraping, data mining, reverse-engineering, or attempting to gain unauthorized access to the Service or its related systems and networks.
7.2. Specific Restrictions on AI-Generated Content
The power of generative AI requires a commitment to responsible use. You may not use the Service to create, generate, or distribute any Content that:
- Is libelous, defamatory, obscene, harassing, abusive, hateful, or otherwise objectionable.
- Constitutes or promotes disinformation, misinformation, or propaganda intended to deceive or mislead the public.
- Creates a "deepfake" of any individual—that is, synthetic media in which a person's likeness or voice is depicted to say or do something they did not say or do—without their explicit, verifiable consent.
- Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity, including using the Voice Cloning feature to replicate a voice you do not have the legal right to use.
- Is used for, or in connection with, any high-risk, automated decision-making processes that could have a legal or material impact on an individual's rights or opportunities, such as in credit, lending, insurance, employment, housing, or legal proceedings.
- Depicts, promotes, or facilitates child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), or any other form of sexual exploitation.
- Promotes self-harm, violence, or incites hatred against individuals or groups based on race, ethnic origin, religion, disability, age, nationality, veteran status, sexual-orientation, gender, gender identity, or any other characteristic associated with systemic discrimination or marginalization.
7.3. Requirement for Transparency
In alignment with emerging ethical best practices for artificial intelligence, when you share or publish Output generated by the Service, we strongly encourage you to proactively disclose that the content is AI-generated. This practice helps prevent deception, builds trust with your audience, and promotes the responsible use of AI technologies.
8. Third-Party Services
8.1. Reliance on Third Parties
You acknowledge that our Service is complex and interoperates with or relies on various third-party products and services to function. These may include cloud infrastructure and hosting providers (e.g., Amazon Web Services, Google Cloud), payment processors, and, critically, underlying AI model providers (e.g., OpenAI, Anthropic, Google) whose technologies we may utilize to process your Inputs and generate Outputs.
8.2. Third-Party Terms
Your use of our Service may be indirectly subject to the terms of service and privacy policies of these third parties. We are not responsible for the practices, content, or policies of these third parties, and we encourage you to review their terms to understand how they operate and handle data.
8.3. Disclaimer of Liability for Third-Party Actions
Our Service, in some instances, acts as a sophisticated proxy or intermediary, routing your Inputs to third-party AI providers for processing. Once your data is transmitted to a third-party provider, it leaves our direct control and becomes subject to that provider's data handling, retention, and security policies. We are not responsible or liable for any loss, damage, or misuse of your data that occurs at the hands of a third-party provider. We work with our partners to ensure they meet high standards of privacy and security, but we cannot guarantee their compliance. You acknowledge and accept this risk as a condition of using the Service.
9. Disclaimers, Limitation of Liability, and Indemnification
9.1. Warranty Disclaimer
THE SERVICE AND ALL CONTENT AND OUTPUT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE AND OUR AFFILIATES, LICENSORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9.2. AI Accuracy Disclaimer
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT OUTPUTS ARE GENERATED BY PROBABILISTIC ARTIFICIAL INTELLIGENCE SYSTEMS. AS SUCH, OUTPUTS MAY BE INACCURATE, INCOMPLETE, BIASED, OFFENSIVE, OR MAY NOT REFLECT OUR VIEWS. YOU MUST NOT RELY ON ANY OUTPUT AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION, OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING ALL OUTPUT FOR ACCURACY AND APPROPRIATENESS FOR YOUR USE CASE, INCLUDING THROUGH RIGOROUS HUMAN REVIEW, BEFORE RELYING ON, USING, OR PUBLISHING IT.
